General terms and conditions

1.Registration

By your registration / reservation or voucher order you recognize these general conditions of the contract as a component of the contract between you and the organizer.

2. Payment terms

Vouchers are to be paid within 30 days and before the flight appointment. Short-term reservations are to be paid on site.

Late payments entitles the organizer to withdraw from the contract and cancellation fees are applicable as defined in paragraph 3.

3. Cancelation by customer before activities begin

The cancelation must occur in writing under addition of the preserved vouchers / ticket - a handling charge is raised. The calculation of the cancelation fees depends on when the written cancelation arrives at Parajoy's offices ( arrivals on  weekends or holidays the next working day is decisive).

Cancelation costs:

Annulation or change of the date the day before the flight until 12:00 o'clock SFr. 50.00 / passenger
Annulation or change of the date the day before the flight after 12:00 o'clock SFr. 100.00 / passenger
Annulation or change on the day of the flight day are not possible for 100% - costs

Late appearance or nonappearance counts as a cancelation. There will be no refund .
If the arranged flight must be shortened due to a late arrival there will be no refund.

4. Cancelation by Parajoy

Parajoy can cancel the activities if the participants do not adhere to Parajoy's policies, endanger Parajoy employees or give cause to serious saftey concerns. In such a case the cancelation fees mentioned in paragraph 3 will be applied.

Should the weather conditions, natual phenomenons, official directives or higher power as well as saftey concerns or other reasons considerable impact or prevent the activity Parajoy has the right to cancel or discontinue the event. In such a case the vouchers are automatically prolonged for one year. Cash payments will be reimbursed to the customer at once.

5. Flight time and landing field

The duration of the passenger flight is influenced by weather conditions. The landing field can be chosen and/or changed by the pilot at any given time under consideration of the wind and weather conditions.

6. Interuption of the activity by the customer

If the participant breaks off the activity or leaves he them prematurely, no restitution or reimbursement will be made. Any additionals costs related to the interruption will be carried by the customer

7. Co-operation obligation and conditions of participation

Participants less than 16 years of age must present either a parent or legal guardian or have a letter of concent from their parents or legal guardian for this activity with them .

The participant declares to fulfill these conditions and to comply to all instructions given to them by Parajoy, the pilots and the pilots aids. If the particpant does not adhere to these participation conditions Parajoy may exclude the participant from the activites. If the exclusion is done before begin of the activiity the terms of cancelation in paragraph 3 apply. If the exclusion takes place after begin of the activity no refunds will be made.

8. Insurance
Paragliding is not considered a hazardous sport and is covered by the Swiss accident insurance (UVG).
Passenger from other countries must have the sufficient sickness and accident insurance coverage (including sport accidents) from their respective contry. The participants are not insured by Parajoy.

9. Liability

9.1. Failure of achievement, less achievement
The organizer compensates you within the scope of these general regulations for the any failure of achievment or lesser achievement then the one upon, if it is not possible to offer an alternative equivalent service and the fault is clearly that of the organizer.

9.2. Disclaimers of liability

If the organizer transfers the execution to a third party, the organizer cannot be held responsible for the third party's actions and/or omissions. In particular the organizer cannot be held accountable for damages or injuries caused by the third party that do not relate to the activities defined by the agreement.
The organizer cannot be made accountable for damages, on the basis of actions of a third-party contracter, other participants, the participant (in particular figure 7), higher power, to natural phenomena, official directives or due to a delay in returning to the meeting point or home.

9.3. Special liability regulations
The transportation during our tandem flights is NOT regulated by the terms of Air Transport Regulations of 17.08.2005.The pilots liability and respectively the contracting party liability adverse the passengers is contractually limited to CHF 72'500.- for death or injury, and to CHF 2'000.- for loss or damage to transported goods.

9.4. External-contractual liability
The external-contractual liability is directed after the appropriate statutes. Provided that these general clauses of a contract intend more austere liability conditions, restrictions of liability or disclaimers of liability, these reach to the application.

Parajoy is not accountable for damages inflicted by third parties, other participants or the participant him/herself (especially in case of paragraph 7), higher powers, natural phenomenons, official directives or due to a delay in returning home.

If a participant does not follow the instructions given by Parajoy or the pilot, accountability by Parajoy is not applicable.

10. Applicable law and jurisdiction
Swiss law is applicable. Both parties agree to Muri AG as the exclusive jurisdictional body.

11. Translations

The customer agrees that these General Terms and Conditions and any other douments published by Parajoy have been originally drawn up in German. These translations may be incomplete. Accordingly the customer agree that in case of any conflict between the German language version and the translations, the German language version shall always prevail.
